Kim Zolciak has released an official press statement via her representative Mike Paul of MGP & Associates PR in response to being sued by Kandi Burruss for “Tardy for the Party.”
The lawsuit led by Kandi Burruss and Rodney Richard aka Don Vito against Kim Zolciak-Biermann over the song “Tardy For The Party” is without merit and suspicious in its timing. We also find the handling of the lawsuit by another cast member on the show, and the timing of Kandi’s attempt to launch her own spinoff reality show, raises serious questions about the true motives behind the filing this lawsuit for alleged record royalties due from a song that was released over three and a half years ago.
The song was created by four people who share in the royalties: Kim, her daughter (who co-wrote the original song in season one of the RHOA show before Kandi joined the show in season two) Kandi and Don Vito. To date, Kim has written checks to Kandi and Don Vito in excess of $23,000. In fact, we believe that Kim may have overpaid a portion of their share to date based on the actual record sales.
But we find the greatest truth in the fact that Kandi Burruss has been in the music business for many years and it appears she has made many mistakes in dealing with the song. We assume this has been a major lesson for Kandi. Maybe focusing on her next 15 minutes of fame should not have been the priority for Kandi…

There’s so much drama surrounding these housewives shows that at times it’s hard to keep up with who’s suing whom! Before one of you (ALLEGED) grown ass fools want to file a lawsuit against a viewer for giving THEIR opinion and watching this train wreck of a show, maybe you “ladies” should think twice before you do stuff like this for ratings/hype and make fools out of yourselves!
Kandi, When you were crying with that shaky voice of yours, on season whatever reunion, discussing the money situation with Kim; you two concluded that you would let the attorney’s take care if it. Obviously, as Kim said, her attorney asked what she was doing by splitting the money the way she was with you because your greedy ass was taking too much! Unless you are a producer who likes to financially rape people, you know damn well that no producer ever gets 50%! If anything you made out like a bandit! You got to get your name out there again! Record your single and whatever else you were recording AND got a spin-off (yawn)!
Before you rock that mouth back and forth and say, “Excuse me, I have a Grammy and I’ve been famous for some time.. blah blah blah! Let’s get real for a minute; had you not been on The Real Housewives of Atlanta and produced Tardy For The Party, the majority of viewers wouldn’t know who you are. Believe it or not Kandi, many people DID NOT know who you were, sure we knew Xscape, but we didn’t know you!
For starters let’s talk about Matthew Solomon, the winner of Kandi’s The Kandi Factory, he’s claiming that he never received his grand prize and hasn’t heard from Kandi since filming, despite her show getting picked up for a full season. Read Matthew’s timeline, it’s quite interesting.
Let’s not forget about Lawrence and his song Closet Freak, remember Lawrence alleges that he wasn’t paid, to top that off Lawrence just tweeted:
So not only did Kandi attempt to pull Kim’s song, she has now pulled Lawrence’s song from iTunes. SMDH! Kandi’s response to Lawrence after his appearance and confession on Hair Stylists Tell All, was he didn’t make money because he didn’t want to pay for Kandi to promote it. Really? Where were was Kandi going to promote the song? Twitter? Kandi Koated Nights? Facebook? YouTube?
For a while your timeline was practicality an advertisement. Don’t you know if you would have tweeted about Closet Freak, you would have been promoting yourself too?
See where I am going? It appears Kandi has issues with people and business. The way it looks to me is, now this my opinion, you used Lawrence, Matthew, and Kim to showcase what your team could do, you and your greed have failed them on every level.
The best course of action for The Real Housewives of Atlanta star Kandi Burruss would be to drop the lawsuit against Kim, pay Lawrence what he’s owed and make good on the promises made to Matthew, otherwise people will continue to believe that Kadi uses people to make a buck.

Well the people are coming out of the woodwork with complaints against Kandi. Check out these tweets from Melissa Rose Louch one of the contestants on Kandi Factory. Based on these tweets, it appears Kandi got what she wanted from the contestants and left them all high and dry.

Wow….I would think all the facts aren’t known or Kandi would not persue this path. She appears to be a savy business woman and I think some people used her for fame and money. Lawrence didn’t seem to understand, it isn’t just Kandi – he has to pay a portion for the work others put into his song, etc.. I am looking forward to reading all the facts from both sides.

My point was it seems all business relationships Kandi has always goes South. I will point out some points too that were on another blog I commented on then it got 2 crazy, LOL just don’t yell at me I’m fragile right now.

this worked out before hand, it can’t be everyone is wrong she is right. if u remember on season b4 last reunion when Kandi was crying & saying that’s all I get. Then Kim said, my atty found out how much I was paying & asked what I’m doing, said I was paying you too much and Kandi shook her head, then thy both agreed to let the atty’s work it out, then Kandi with her shaky voice cry said, “but you think that is all I should get”? Thy both agreed to let the atty’s work it out and decide how it is split. so they did. I bet u Kandi didn’t expect Kim to outsell her in songs. Brielle started to play with the song when NeNe said it had potential, then Kandi came along.
Let’s face it, Kandi is no Patti Labell or Aretha Franklin. If she didn’t need the spot light again, she wouldn’t of did RHOA, they make peanuts the 1st cpl of seasons. If Kandi is such a super star, then she wouldn’t of needed RHOA. Remeber too at that time when Kandi joined, celebs wanted nothing 2do with housewives. It was her ex xscape/band mate that passed up RHOA and referred them 2 Kandi. They now have a shoe on vh1… T.I. & Tiny
We all heard kim’s HORRIBLE voice, if it weren’t for Kandi re doing the song, Kandi wouldn’t of got a spin off. Let’s face it, with out RHOA there would be no Kandi Factory.
I do think Kandi should be paid but how much? No prod. makes 50%. She is talking about studio time? Huh? If Lawerance, Kim and the guy frm Kandi factory wouldn’t of filmed with her, then no one would of been able to see what she could do now. TLC – no scrubs was years ago.
Kandi admitted that good things came for her since doing TFTP. Like I said above, Kandi tweeted that Lawersnce didn’t wanna pay studio time. Huh? U two filmed. U scratch my back, ill scratch urs. I cant see Lawerwnce agreeing to pay that . Believe me, I am.no.fan.of.Kim. if you Google Kim Zolciak Tenant from Hell you will see an article I did.
If you get a minute see what that guy from Kandi Factory had to say. He was never a friend either. With out these ppl, there would be no Kandi Factory.

This is getting interesting. Why aren’t these two suing Kandi and Bravo? Bravo TV has an obligation even if they are just he network. This is false advertising. The viewers are led to believe that they will get a song on itunes and a video. Why does Kandi get to profit but the kids can’t who participated that were promised? It may say in the contract that the contestant can not sue; but when the one making the contract violates their own contract it becomes null. Kandi is only thinking about Kandi and I am not comfortable with this. I am really disappointed. How can she promise these kids this and not make her end of the deal? Why does Kandi get to have a second season when she has not finished up with her duties with the first season?
Is there a way to ask the runner ups about any of this? How about Kandi? What does she have to say for herself?
I just feel horrible for these two kids. No matter what Kandi says at this point, there is no reason or excuse for this. She can say that her team was going to do this or that, the appropriate thing to do is for her at that point to reach out to them.
I did not like the way Kandi talked about the contestants on the show and gave her benefit of the doubt.
It looks to me like these kids were slaves in her Kandi Factory.
That’s the question everyone is asking. Don what’s his name, Kandi’s whipping boy tried to claim in a tweet to me that the contestants received everything they were promised. He also tried to lay the blame at Bravo’s doorstep, saying it was Bravo who was responsible.

Eh, I feel like this is reaching. I believe the winner of Kandi’s show was promised a video and a song. He had a song and he had a video. What else is he looking for?
The runner up, same thing with her. Seems like they are upset bc they expected more from her and didn’t really read the fine lines. If they had an issue why have they not contacted a legal advice, not using Twitter to have people harass Kandi into speaking to them?
And most importantly, I have a feeling that all of these people have signed or set up something we don’t know about that probably explains why there is no more “movement” with the transaction. I have a good feeling about that with the Kandi factory winners. As far as Kim, her track record with agreements and deals is pretty poor so she does not really have a strong case unless she has receipts. I really only have to say for those winners for the Kandi factory to really use your judgement wisely, maybe find a better way to get your point across than really making a scene and then burning bridges for your future. Not only is Kandi watching but the rest of the music industry and I am for sure that if I was an executive and I read about you ranting about another well known artist that I would not feel comfortable working with you. That’s all I am thinking. Hope this works out for everyone though.
The winner was promised his song on iTunes which Kandi blocked from happening. Anyone can put a song on iTunes. Kandi and Vito want to tap in that too. Kandi and Vito need to understand if they want to make their show anything like an American Idol show they better stop expecting so much. With out contestants there would be no show. Of course my statement doesn’t reflect or represent tvfishbowl!!
